  • Divorce Strategy Consultation with Suzy Miller to provide a clear roadmap of the process.

 

  • Chartered Financial Planner: Assessing the current and future financial needs of each party and any children, and modelling the effect of different ways of dividing property, pensions and other assets. Creating up to two practical settlement scenarios, showing the longer-term financial implications for each party, for discussion and refinement in mediation. (P.S. Lawyers rarely suggest you do this bit first – even though it’s obviously the sensible thing to do).

 

  • Divorce Communication Coach: Three sessions (two separately and one as a couple) with a Divorce Coach (who also can ensure there is no bullying or power imbalance) to prepare for mediation. Are you both clear on the future you want for yourselves? Well now is the time to gain that clarity, as it may impact the way you split the finances.

 

  • Mediation with a specialist mediator: You will cut a deal based upon the financial projections. MIAMS and a joint session included (and should be all you need if you follow our system). BTW – you don’t have to be friends to make mediation work.

 

Optional extra sessions available if required. Even if things turn messy you will still be in a strong position to stay out of court. (We have a special strategy for those difficult divorces.) But for those of you who are able to have a sensible discussion but are not qualified to split pensions, understand long term cashflow forecasting or are just really nervous about the whole thing – this service will be right for you.

 

Total cost: £2,500 – Split between the two of you

 

Online Consent Order Service (once agreement is reached) will turn your D81 (which you can easily complete based on what’s agreed in mediation) and submit online at the conditional stage of the divorce process. This is way less than the cost of using a regular solicitor and our service allows you to access this low cost Consent Order service.

You will not find anywhere a comparable service at such a low fee suited to support a couple who want to be amicable – but can’t yet agree what is the best way to split the finances. Most online services rely on you agreeing already and knowing how to create a fair and equitable split,

What are you other options?

 

1: Work with lawyers. Many reputable and honest family lawyers exist – but most of the time you don’t need legal advice. With our fixed-price offering, we want you to get this divorce done and dusted ASAP, and to limit the need for solicitors as much as possible.

2: DIY online. Fine if you already have your financial agreement worked out. But is it fair? Does it look at long term implications? Is it tax efficient? If not you could end up agreeing to a rubbish deal, or just get turned away if you’re not already clear on how to do the financial split. Some online services refer many clients to lawyers because you don’t fit into the box they require to provide you with a Consent Order service – or they may offer a special service to help you work out the financial split. But does it include a qualified life coach, financial planner and mediator? (No, it doesn’t. Only our fixed-price service offers that).

3: Not bother with the Consent Order. Bad idea. Legally your divorced spouse can still chase you for money in the future. Don’t you want to sleep well at night?

4: Work with lawyers and use our fixed-price divorce service. You are welcome to be getting independent legal advice throughout. Your lawyer can be in a break out room in the mediation session so you can stop and consult with them whenever you want. However, you may find they don’t actually have very much to do because now YOU are in charge of this divorce. Not the lawyers.

You will find companies who will help you work out how to negotiate a settlement away from lawyers, but they can still cost you a combined fee of just under £6,000 (that’s right. So much for low cost online services!)

Henry Elliston is a Chartered Financial Planner at The Family Wealth Partnership and an associate member of Resolution, with specialist experience in financial planning on divorce. Henry believes in helping people to clarify and realise their dreams and goals through their financial planning. He is able to provide detailed financial guidance for couples navigating divorce with a view to the future they want to create for themselves – and for their now extended family.

  • One or both of the couple working with a Chartered Financial Planner who specialises in divorce finances;
  • Assessing the current and ongoing needs of the couple and any children post-divorce, including pensions and splitting assets in the most financially efficient and cost-effective way.
  • Standard needs and cash-flow modelling creating a maximum of two settlement scenarios to then be discussed, refined and agreed upon in mediation.
  • An optional but recommended full financial plan at a reduced cost, to focus on your future needs once the divorce finances are settled, helping you make the most of your assets going forward.

Mediation Sessions – cutting a deal:

To resolve division of matrimonial assets on the basis that the couple have the financial options created with the Financial Planner already available – even if not yet agreed upon.

  • 1 joint MIAM meeting
  • 1 mediation meeting (MM)
  • Memorandum of Understanding (MOU) & Open Financial Statement (OFS)  (needed to obtain a consent order)
  • Joanne trained with National Family Mediation and is a member of Resolution Family Law Association.

If other issues arise and longer is needed, you can book additional sessions directly. However, if you have worked with the financial expert first, you really shouldn’t need long to address any questions you may have and come to an agreement.

Creating the Consent Order to submit online:

  • Creating a Consent Order via an online legal services company using the MOU and OFS (from the mediator) to complete your D81 and submit online at the conditional stage of the divorce process – which will now be straightforward. You can access this service direct for only £599 from our recommended company (possibly for less if your divorce finances are very simple). The service includes one of you to have an optional 30 mins legal advice session.
  • When you submit this Consent Order (online – you can do it yourself) then when you apply for the Final Order, your Consent Order is accepted by the court and becomes legally binding! Everyone can now sleep at night. The financial agreement is secure.

So why don’t lawyers offer a similar fixed-price service?

Well because they are not needed that much. If you do need legal advice is may be over property, a business, or immigration status. So a property lawyer, a commercial lawyer and an immigration lawyer might be required (all of whom we can refer you to). Rarely do you need to work with a family lawyer if you follow our stay out of court strategy.

You can pay for a lawyer to give legal advice, but most of the divorce is children and finance and there is’t really that much ‘law’ involved. Most court decisions are based on what a judge decides and as one barrister once told me, as to what they decide it’s like tossing a coin. You can’t know in advance. So why even put yourself in that position when by following a logical divorce management programme, you may not need a lawyer at all to agree the finances?

However, regarding the fixed-price legal service we recommend to create your Consent Order – that does include a 30 mins legal advice consultation, to make sure you understand the agreement you’ve come to. But since you will have already worked with a divorce coach, a financial expert and a mediator – chances are you will be pretty clued up!

But if you want a lawyer by your side, we can recommend solicitors that are genuinely committed to stay out of court divorce, and you can use their services ‘unbundled’  to give advice when you need it, or even attend the mediation with you (in a break out room). It’s your money, your additional cost. You are in charge of this divorce. You do what’s right for you.
